Martingale Risk Italia Srl is promoting a class action lawsuit against the Swedish truck manufacturer Scania, in which all those who purchased (including in the form of leasing) trucks from Scania or from the companies MAN, Volvo/Renault, Daimler, Iveco and DAF between 1997 and 2011 can participate.
Martingale Risk's class action follows the EU Court of Justice's decision of Feb. 1, 2024, which upheld the €880 million fine already imposed by the European Commission in 2017 on Scania ("Scania AB," "Scania CV AB" and "Scania Deutschland GmbH") for participating in the truck cartel. Scania, unlike the other truck cartelists, had not entered into an agreement with the Commission and, appealing the sanctions, filed an appeal before the General Court of the European Union, which was later dismissed in a ruling on Feb. 2, 2022. On April 8, 2022, Scania had filed a further appeal to the EU Court of Justice, and on February 1, 2024, the latter rejected it, confirming the penalty imposed by the Commission.
For owners of trucks over 6 tons sold by the companies Scania, MAN, Volvo/Renault, Daimler, Iveco, and DAF, there is thus an opportunity to claim and recover damages suffered from the price increase due to the cartel, in the 14 years between 1997 and 2011. Specifically, the European Commission's sanctions related to collusive agreements on wholesale prices and passing on to customers the costs of complying with emission standards.
Damages to truck buyers are estimated to be in the range of 10 percent to 12 percent of the purchase price, to which must be added interest and monetary revaluation from the date of purchase (or lease). Interest and revaluation can also be of a very significant amount, since the damage occurred many years ago.
